These Terms of Use (hereinafter referred to as "these Terms") set out the conditions for participating in surveys conducted by Touko Co., Ltd. (hereinafter referred to as "our company"). Please agree to these Terms before participating in the survey.

Article 1 (General Provisions)

1. These terms and conditions are set out by Touko Co., Ltd. (hereinafter referred to as "our company") and define the rights and obligations between respondents and our company regarding our online research business.
2. Respondents agree to and comply with these terms and conditions.
3. If you do not agree to the terms and conditions, please refrain from answering the survey.
4. If a respondent responds to a survey conducted by Touko Co., Ltd., we will assume that the respondent has agreed to these Terms and Conditions, etc.
5. The Company may change these Terms and Conditions without obtaining prior consent from the Respondent, and the Respondent shall abide by the changed Terms and Conditions.

Article 2 (Responses to the survey)

1. We will request survey participants selected according to the purpose of the survey by email or other means to participate in the survey. We will not be able to accept requests to participate in the survey from people who are not the survey target.
2. Survey respondents shall, in accordance with our instructions, access the online response page provided by us via email or by other means, and answer the questions posted on that page online by the closing date. However, we may close the acceptance of responses earlier than announced if we reach a number of respondents that we deem sufficient in light of the purpose of the survey, or for other reasons, and in such cases, respondents understand that they may not be able to respond, even if they are survey respondents.
3. Respondents shall bear all costs, including internet connection fees, communication fees, packet usage fees, etc., incurred when responding to surveys, confirming or changing registered information, or making other inquiries or contacting our company by telephone, fax, or email. Respondents shall also bear all costs, including internet connection fees, communication fees, packet usage fees, fax paper fees, etc., incurred when our company requests respondents to cooperate in surveys or contacts them.
4. Respondents should complete the survey honestly and, to the best of their ability, answer all questions.

Article 3 (Prohibitions for Respondents)

1. All copyrights and other rights to information distributed or provided when requesting cooperation in a survey are owned by our company or our customers, and providing information does not grant these rights to respondents. Respondents may not use the information provided without permission. Linking to or disclosing the URL of the response site without permission is also prohibited.
2. Respondents shall not engage in any of the following acts or acts that may be considered to be such acts:
- Actions that violate public order and morals
- Any act that violates laws, ordinances, or other regulations.
- Any act that infringes the copyright or other rights of our company, other respondents, or third parties.
- Any act of slandering or libeling other respondents or third parties
- Any act that causes harm to other respondents or third parties
- Election campaigning or similar activities
- Any act that interferes with the operation of this project
- Submitting false registrations or survey responses
- Intentionally leaving answers blank
- Any business activities not approved by our company
- Registering/answering while impersonating another person
- Duplicate responses by one respondent to the same survey
- Intentional collective voting by multiple people on a specific part of the same survey
- Disclosing or leaking the survey content or response site URL to a third party (including after you have left the monitor membership)
- Unauthorized use, transfer, lending, etc. of user ID or password
- Buying and selling the right to receive rewards, or putting it up for auction, etc.
- Any unauthorized use of this site for commercial purposes
- Any other act that the Company deems inappropriate

Article 4 (Handling of response data)

1. We will use and manage the data sent and accumulated by respondents (hereinafter referred to as "response data") in accordance with our [Privacy Policy]( https://mashiko.com/privacy/ ).
2. Personal information collected from responses will not be provided to third parties without the respondent's consent.
3. Response data, excluding personal information, may be viewed or downloaded by our customers.
4. Response data to free-form questions will also be saved in a state where it can be viewed and downloaded by our customers, so please do not write any information in this section that may cause inconvenience if viewed or downloaded, such as personal information or matters that violate the provisions of Article 3 of these Terms of Use. Furthermore, neither our company nor our customers will bear any responsibility for any disadvantages suffered by respondents as a result of writing such information.
5. Once a response has been submitted, even if a respondent requests confirmation, disclosure, correction, or deletion of the content of the response data, the Company may not be able to comply with such request.
6. Respondents shall not be able to claim any rights, including copyright, to the response data, and the Company shall be able to freely select, modify, edit, and delete the response data.
7. Our company, our customers, or persons designated by them may freely use the response data, excluding personal information, and may disclose or publish it without the consent of the individual.

Article 5 (Remuneration)

1. As a reward for completing the survey, you will receive a "Touko Gift Card worth 500 yen."
2. If we determine that any conduct or responses you have made in response to a survey are clearly dishonest or inappropriate, in violation of Article 3 of these Terms and Conditions, we may not provide you with any reward for that survey, or you may request the return of any prizes that have already been provided.
3. Prizes and other items will be shipped to respondents within Japan to their registered contact address or email address, or to the contact address or email address entered when responding. We shall not be held responsible for any non-delivery of prizes and other items due to incorrect registration or description of such contact information or other imperfections.
4. We shall not be liable for any disadvantage or damage suffered by a respondent due to non-delivery of prizes sent or distributed by us to the contact address or email address registered or entered at the time of responding.

Article 6 (Other)

1. We make no guarantee that the information we provide through surveys at the request of our customers is accurate or that it is not harmful or offensive to respondents.
2. We shall not be liable for any damages incurred by respondents, such as being unable to receive their reward, due to interruption, delay, cancellation, or loss of data from this survey service caused by communication line or computer failures, etc.
3. The Company may, after giving a notice period that the Company deems appropriate, change all or part of the content of the Project, or temporarily suspend, stop or terminate all or part of the Project, regardless of whether the Respondent has consented. The Company shall not be liable for any disadvantage or damage that may be incurred by the Respondent as a result of this.
4. If a respondent violates these Terms and Conditions and causes damage to our company or a third party, our company may invalidate all prizes, etc. that the respondent has received and may claim damages from the respondent.
5. In the event that litigation becomes necessary between the respondent and our company, the Utsunomiya District Court shall be the exclusive court of first instance.

Supplementary Provision: These Terms of Use will come into effect on June 1, 2024.
